Fishing Adventures by Luca Nardin» und "GUIDED FISHING": Allgemeine Geschäftsbedingungen (AGB’s)

Für das entgegengebrachte Vertrauen und Interesse bedanken wir uns bei Ihnen. Die folgenden Allgemeinen Geschäftsbedingungen (AGB’s) gelten für alle Leistungen der “Fishing Adventures by Luca Nardin». Wir bitten Sie, die AGB’s genau zu lesen. Hier werden die vertraglichen Bedingungen zwischen der “Fishing Adventures by Luca Nardin» und Ihnen («dem Kunden») geregelt.

1. Vertragsabschluss

Mit der persönlichen, schriftlichen (auch per E-Mail), elektronischen (online) oder telefonischen (mündlichen) Buchung, kommt zwischen dem Kunden und der “Fishing Adventures by Luca Nardin» (“Fishing Adventures by Luca Nardin») ein Vertrag zustande. Auf diesen Vertrag sind die vorliegenden AGB anwendbar. Spätestens mit Zahlung der Rechnung (auch Anzahlung) akzeptiert der Kunde Erhalt und Inhalt der AGB’s. Der Kunde ist verantwortlich für die Mitteilung der korrekten persönlichen Daten (Namen und Geburtsdatum gemäss Angaben im Reisepass) an die “Fishing Adventures by Luca Nardin». Ebenso liegt es in der Verantwortung des Kunden, nach Erhalt der Rechnung/Bestätigung alle Angaben auf Vollständigkeit und Richtigkeit zu überprüfen. Unstimmigkeiten müssen umgehend an die “Fishing Adventures by Luca Nardin» gemeldet werden.

2. Zahlungsbedingungen und Preise
2.1 Zahlungsbedingungen
Es gelten die Zahlungsbedingungen gemäss Angaben auf der Rechnung/Bestätigung. Anzahlung bei Erhalt der Rechnung/Bestätigung, gemäss Angaben auf der Rechnung/Bestätigung. Restzahlung, sofern auf der Rechnung/Bestätigung nicht anders vermerkt, bis spätestens 30 Tage vor Abreise.

2.2 Preisangaben
Alle Preisangaben auf der Website sind Nettopreise in EURO.

2.3 Preisänderungen
In den nachfolgenden Fällen hält sich die “Fishing Adventures by Luca Nardin» eine Preiskorrektur vor:

· Neue oder erhöhte staatliche Abgaben oder Gebühren (z.B. Mehrwertsteuer, Flughafentaxen, Treibstoff, Kurtaxen usw.)

· Offensichtliche Druck- und Publikationsfehler

· Preisänderungen von Transportunternehmen und/oder anderen Leistungsträgern

Wenn die Preiserhöhung mehr als 10% des ursprünglichen vereinbarten Reisepreises ist, haben Sie das Recht, innert 5 Tagen nach Erhalt dieser Mitteilung, vom Vertrag zurückzutreten.

3. Gültigkeit von gebuchten Leistungen
Die gebuchten Leistungen sind nur an den auf der Rechnung/Bestätigung aufgeführten Daten gültig.

4. Annullierungsbestimmungen
Die Annullierungskosten variieren je nach gebuchter Leistung.

4.1 Annullierung der Guidingleistungen inkl. Unterkunft durch den Kunden
Bei Annullierungen verfällt die Anzahlung. Diese wird nicht zurückerstattet. Nach Möglichkeiten schlägt “Fishing Adventures by Luca Nardin» Ihnen unverbindlich ein alternatives Reisedatum vor.

4.2 Annullierung von Gruppenreisen
Bei Annullierungen von Gruppenreisen haftet die Person, welche die Reise storniert, für die anfallenden Mehrkosten der verbleibenden Teilnehmer.

4.3 Annullierung durch den Veranstalter
“Fishing Adventures by Luca Nardin» hält sich das Recht vor, eine eigene Leistung ohne Angabe der Gründe zu annullieren. In solchen Fällen wird Ihnen der einbezahlte Betrag voll zurückerstattet. Ein weiterer Schadenersatzanspruch besteht nicht. “Fishing Adventures by Luca Nardin» bemüht sich, Ihnen ein gleichwertiges Ersatzprogramm zu offerieren. Sollten Umstände höherer Gewalt (Unruhen, Streiks, Naturkatastrophen, behördliche Anordunungen, Pandemien, Epidemien, oder ähnliche Ereignisse) dem Veranstalter es verunmöglichen die Reise wie vereinbart durchzuführen, kann der Kunde keine Rückerstattung geltend machen.

4.4 Sonstige Annullierungsbestimmungen
Sofern keine anderen Annullierungskosten (siehe 4.1 bis 4.4) vereinbart worden sind, fallen folgende Annullierungskosten an:

· Bis 60 Tage vor Reisebeginn: 50%

· 59 Tage bis 30 Tage vor Reisebeginn: 90%

· 29 Tage vor Reisebeginn und weniger: 100%

5. Reiseversicherungen
Der Abschluss einer Reiseversicherung (Annulationskostenversicherung, Reiseschutzversicherung) wird dringend empfohlen. Verzichtet der Kunde auf einen Versicherungsabschluss, so bestätigt er damit, über eine ausreichende private Versicherungsdeckung zu verfügen. Der Kunde stellt sicher, dass er für Unfälle und Krankheiten im Ausland ausreichend versichert ist. Wichtig: “Fishing Adventures by Luca Nardin» empfiehlt den Kunden, sich vor Abreise über bestehende Reiseversicherungen zu informieren.

6. Vorzeitige Rückreise/Reiseabbruch
Falls der Kunde seine Reise abbricht oder während der Reise die definierten Leistungen ändert, besteht kein Anspruch auf Rückerstattung. Bei Reiseabbruch oder Änderung der Reiseleistungen gehen die (Zusatz)Kosten zulasten des Kunden.

7. Zustellung der Lizenzen (Vispas)
Sofern diese Leistung gebucht wurde, beschafft “Fishing Adventures by Luca Nardin» die notwendigen Angellizenzen. Diese werden dem Kunden bei Ankunft am Reiseort übergeben. Im Falle, dass der Kunde diese Leistung nicht gebucht hat, muss er persönlich sicherstellen im Besitze von gültigen Angellizenzen zu sein. “Fishing Adventures by Luca Nardin» übernimmt keine Haftung für fehlende Angellizenzen.

8. Beanstandungen
8.1 Beanstandung vor Ort und Abhilfe verlangen
Sollte der Kunde während der Reise Anlass zu Beanstandungen haben, so müssen diese zwingend und unverzüglich gemeldet werden. Dies ermöglicht meist bereits eine Abhilfe vor Ort.

8.2 Wetter- und Fanggarantie
Das Angeln ist ein Sport der in der Natur stattfindet und witterungsabhängig ist. “Fishing Adventures by Luca Nardin» stellt die Sicherheit der Kunden an erste Stelle. Daher kann es vorkommen, dass aufgrund zu starker Winde, Nebel oder Eis keine Ausfahrt auf die Seen möglich ist. In solchen Fällen sucht “Fishing Adventures by Luca Nardin» nach möglichen Alternativen, kann aber keine Durchführungs-Garantie abgeben. Angeln ist ein Natursport und Fische zu fangen ist eine sportliche Herausforderung. Die angebotenen Guiding-Leistungen von “Fishing Adventures by Luca Nardin» stellen keine Fanggarantie dar. Der Kunde kann keine Minderung der Leistungen geltend machen.

9. Haftung
Die Haftung ist auf den Preis für die von einem Schaden betroffene Leistung beschränkt. Diese Beschränkung gilt nicht für Personenschäden und nicht bei Vorsatz oder Grobfahrlässigkeit. Die Ansprüche müssen spätestens 4 Wochen nach Reisebeendigung schriftlich bei “Fishing Adventures by Luca Nardin» eingereicht werden; sonst ist der Anspruch verwirkt. Alle Schadenersatzforderungen verjähren innerhalb von 1 Jahr nach Reisebeendigung.

9.1 Haftungsausschlüsse
“Fishing Adventures by Luca Nardin» haftet nicht, wenn die Nichterfüllung oder die nicht gehörige Erfüllung des Vertrages zurückzuführen ist auf:

· Versäumnisse von Kundenseite

· Unvorhersehbare oder nicht abwendbare Versäumnisse eines Dritten, der an der Erbringung der vertraglich vereinbarten Leistungen nicht beteiligt ist

· Höhere Gewalt oder ein Ereignis, welches “Fishing Adventures by Luca Nardin» oder ein Dienstleistungsträger trotz aller gebotenen Sorgfalt nicht vorhersehen oder abwenden konnte.

· Die auf der Reise verursachten Folgen von Produkte-, Werk- und Sachmängeln.

· Änderungen im Reiseverlauf, die auf Streik, Unruhen, Witterungsverhältnissen, behördlichen Massnahmen, Verspätungen von Dritten usw. zurückzuführen sind.

10. Anwendbares Recht und Gerichtsstand
Im vertraglichen Verhältnis zwischen dem Kunden und der “Fishing Adventures by Luca Nardin» ist ausschliesslich schweizerisches Recht anwendbar. Der Gerichtsstand ist Solothurn, Schweiz.

Fishing Adventures by Luca Nardin" and "GUIDED FISHING": General Terms and Conditions (GTC's)

We would like to thank you for your trust and interest. The following General Terms and Conditions (GTC’s) apply to all services of "Fishing Adventures by Luca Nardin". We ask you to read the GTC’s exactly. Here the contractual conditions between the "Fishing Adventures by Luca Nardin" and you ("the customer") are regulated.

1. Conclusion of contract

With the personal, written (also by e-mail), electronic (online) or telephone (oral) booking, a contract is concluded between the customer and "Fishing Adventures by Luca Nardin" ("Fishing Adventures by Luca Nardin"). This Agreement shall be governed by these Terms and Conditions. At the latest with payment of the invoice (also down payment), the customer accepts receipt and contents of the Terms and Conditions. The customer is responsible for providing the "Fishing Adventures by Luca Nardin" with the correct personal data (name and date of birth as stated in the passport). It is also the customer's responsibility to check the completeness and accuracy of all information upon receipt of the invoice/confirmation. Any discrepancies must be reported immediately to "Fishing Adventures by Luca Nardin".

2. Terms of payment and prices

2.1 Terms of payment

The terms of payment as stated on the invoice/confirmation shall apply. Down payment upon receipt of invoice/confirmation, as stated on the invoice/confirmation. Final payment, unless otherwise stated on the invoice/confirmation, no later than 30 days before departure.

2.2 Price information

All prices quoted on the website are net prices in EURO.

2.3 Price changes

In the following cases "Fishing Adventures by Luca Nardin" reserves the right to make a price adjustment:

- New or increased government charges or fees (e.g. VAT, airport taxes, fuel, visitor's tax, etc.)

- Obvious printing and publication errors

- Price changes by transport companies and/or other service providers

If the price increase is more than 10% of the original agreed travel price, you have the right to withdraw from the contract within 5 days of receipt of this notification.

3. Validity of booked services

The booked services are only valid on the dates stated on the invoice/confirmation.

4. Cancellation conditions

Cancellation costs vary depending on the service booked.

4.1 Cancellation of guiding services incl. accommodation by the customer

In case of cancellation, the deposit is forfeited. This will not be refunded. If possible, "Fishing Adventures by Luca Nardin" will suggest an alternative date for your trip.

4.2 Cancellation of group trips

In the event of cancellations of group trips, the person cancelling the trip shall be liable for any additional costs incurred by the remaining participants.

4.3 Cancellation by the Tour Operator

"Fishing Adventures by Luca Nardin" reserves the right to cancel its own service without stating the reasons, or if the trip cannot be carried out for compelling reasons (e.g. force majeure, war, unrest, strikes, etc.). In such cases, the amount paid will be refunded in full. There is no further claim for damages. "Fishing Adventures by Luca Nardin" tries to offer you an equivalent replacement program. If circumstances of force majeure (riots, strikes, natural disasters, official orders, pandemics, epidemics, or similar events) make it impossible for the organizer to carry out the trip as agreed, the customer cannot claim a refund.

4.4 Other Cancellation Conditions

If no other cancellation costs (see 4.1 to 4.4) have been agreed, the following cancellation costs shall be incurred:

- Up to 60 days before departure: 50%.

- 59 days to 30 days before departure: 90%.

- 29 days before departure and less: 100%.

5. Travel insurance

The conclusion of a travel insurance (cancellation cost insurance, travel protection insurance) is strongly recommended. If the customer waives an insurance policy, he confirms that he has sufficient private insurance coverage. The customer shall ensure that he is adequately insured for accidents and illnesses abroad. Important: "Fishing Adventures by Luca Nardin" recommends that customers inform themselves about existing travel insurance before departure.

6. Early return/abort of travel

If the customer interrupts his trip or changes the defined services during the trip, there is no right to a refund. In the event of travel being interrupted or the travel services being changed, the (additional) costs shall be borne by the customer.

7. Delivery of the licenses (Vispas)

If this service is booked, "Fishing Adventures by Luca Nardin" procures the necessary fishing licenses. These will be handed over to the customer upon arrival at the destination. In the event that the customer has not booked this service, he must personally ensure that he is in possession of valid fishing licenses. "Fishing Adventures by Luca Nardin" assumes no liability for missing fishing licenses.

8. Complaints

8.1 Complaint on site and demand remedy

If the customer should have cause for complaints during the journey, then these must be announced compellingly and immediately. In most cases, this already enables a remedy on the spot.

8.2 Weather and catch guarantee

Fishing is a sport that takes place in nature and depends on the weather. "Fishing Adventures by Luca Nardin" puts customer safety first. Therefore it can happen that due to strong winds, fog or ice it is not possible to go out on the lakes. In such cases "Fishing Adventures by Luca Nardin" searches for possible alternatives, but cannot give any performance guarantee. Fishing is a natural sport and catching fish is a sporting challenge. The guiding services offered by "Fishing Adventures by Luca Nardin" do not constitute a catch guarantee. The customer cannot claim any reduction of the price.

9. Liability

Liability is limited to the price for the service affected by the damage. This limitation does not apply to personal injury and not to intent or gross negligence. Claims must be submitted in writing to "Fishing Adventures by Luca Nardin" no later than 4 weeks after the end of the trip; otherwise the claim will be forfeited. All claims for damages expire within 1 year after the end of the trip.

9.1 Exclusions of liability

"Fishing Adventures by Luca Nardin" shall not be liable if the non-performance or improper performance of the contract is due to:

- Failures on the part of the customer

- Unforeseeable or unavoidable failures of a third party who is not involved in the provision of the contractually agreed services

- Force majeure or an event which "Fishing Adventures by Luca Nardin" or a service provider could not foresee or avert despite all due care.

- The consequences of product, work and material defects caused during the trip.

- Changes in the itinerary due to strikes, unrest, weather conditions, official measures, delays by third parties, etc.

10. Applicable law and place of jurisdiction

The contractual relationship between the customer and "Fishing Adventures by Luca Nardin" shall be governed exclusively by Swiss law. The place of jurisdiction is Solothurn, Switzerland
